Maine's minimum wage will rise from $15.10 to [$15.70 an hour on January 1, 2027](https://www.maine.gov/labor/news_events/article.shtml?id=13362373), and the same release moves the tipped service wage, the tip threshold and the salary line for overtime exemption. If you work a register, a kitchen line, a farm crew, a front desk or a care shift anywhere in the state, your hourly floor goes up without anyone asking your employer for it. Tipped workers, salaried shift supervisors and anyone working inside Portland city limits each have a separate number to check, and the raise matters only if it actually shows up on the pay stub. At [Metaintro](https://www.metaintro.com) we read a wage change by going past the headline to the statute, the workplace poster and the complaint form, because those are the pages that tell a worker what they are owed and what to do when they do not get it. Below is every number that changes, why it changes, and how to claim it.

## What Exactly Changes on January 1 for Maine Workers?

Four numbers move at once. The state minimum wage rises from [$15.10 to $15.70 an hour](https://www.maine.gov/labor/news_events/article.shtml?id=13362373), which for a full time worker adds up to [$24 a week, or $1,248 a year, before taxes](https://www.bangordailynews.com/2026/09/18/politics/state-politics/maine-minimum-wage-increase-2027/). The direct cash wage for tipped service employees goes from [$7.55 to $7.85 an hour](https://www.maine.gov/labor/news_events/article.shtml?id=13362373). The amount of tips a worker must regularly receive to count as a service employee rises from [$191 to $199 a month](https://www.maine.gov/labor/news_events/article.shtml?id=13362373). The salary a worker must be paid before an employer can treat them as exempt from overtime becomes [$905.79 a week, or $47,101.08 a year](https://www.maine.gov/labor/news_events/article.shtml?id=13362373).

Coverage is close to universal. The state's own 2027 workplace poster spells out that all agriculture and nonagriculture businesses operating in Maine with [one employee](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf) are covered by the state law, public and private, regardless of profit or size.

Farm workers are in that group now. Agricultural workers became entitled to the state minimum after the Legislature enacted and the governor signed [a 2025 act establishing a state minimum hourly wage for agricultural workers](https://www.maine.gov/labor/news_events/article.shtml?id=13362373), and the new poster lists a single rate for [agriculture and non-agriculture work](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf). If you pick, pack or tend animals on a Maine farm, the raise applies to you on the same day it applies to a grocery cashier.

## Why Does the Wage Go Up Every Year Without a New Vote?

Because the law is written that way. Title 26, section 664 of the Maine statutes sets the rate and, starting on [January 1, 2021 and each January 1st thereafter](https://legislature.maine.gov/legis/statutes/26/title26sec664.html), requires the wage then in effect to rise with the cost of living. The measure is the change from August to August in the [Consumer Price Index for Urban Wage Earners and Clerical Workers](https://legislature.maine.gov/legis/statutes/26/title26sec664.html), known as CPI-W, for the Northeast Region, as published by the federal Bureau of Labor Statistics. The increase is rounded to the nearest nickel.

That formula came from voters, not lawmakers. Maine voters amended the law [by referendum in 2016](https://www.maine.gov/labor/news_events/article.shtml?id=13362373), and the statute stepped the rate up through [$12.00 an hour in 2020](https://legislature.maine.gov/legis/statutes/26/title26sec664.html) before automatic indexing took over. This year's input was a [4.1 percent increase in the CPI-W](https://www.maine.gov/labor/news_events/article.shtml?id=13362373) between August 2025 and August 2026, and the raise that came out of the formula is [just shy of 4%](https://www.bangordailynews.com/2026/09/18/politics/state-politics/maine-minimum-wage-increase-2027/) once rounding is applied.

It has not always worked like this. For decades Maine raised its wage in fits and starts, and the state's own history page records that earlier attempts to tie the minimum to the cost of living [all failed to pass](https://www.maine.gov/labor/labor_laws/minwagehistory.html). The first uniform state minimum took effect in [1959 at $1 an hour](https://www.maine.gov/labor/labor_laws/minwagehistory.html). Indexing is the reason low wage workers no longer have to wait for a political fight to catch up with rent and groceries.

There is also a federal backstop in the text. If the federal minimum is ever raised above Maine's, the state rate [rises to match it](https://legislature.maine.gov/legis/statutes/26/title26sec664.html) on the same date and keeps indexing from there.

## What Do Tipped Servers and Bartenders Take Home Under the New Rules?

At least [$7.85 an hour in cash](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf) from the employer, plus tips, with a guarantee underneath. The employer must be able to show that the worker receives at least [$15.70 an hour when the direct wage and tips are combined](https://www.maine.gov/labor/news_events/article.shtml?id=13362373) at the end of the week. If tips run short, the employer pays the difference, and the 2027 poster states it plainly for anyone whose wage and tips [do not average the state minimum on a weekly basis](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf).

The statute adds protections most servers never read. The tip credit an employer takes may not exceed [50% of the minimum hourly wage](https://legislature.maine.gov/legis/statutes/26/title26sec664.html), and an employer who uses it must tell the worker in advance, orally or in writing, how much direct wage it will pay and how much of the tips it will count. A tip credit cannot apply to anyone who was never told about it.

Tips belong to you. Under the same section, tips become the property of the employee and [may not be shared with the employer](https://legislature.maine.gov/legis/statutes/26/title26sec664.html). Card tips must be paid out by the next regular payday, and the employer may not deduct credit card processing fees from them. Tip pools are allowed only among service employees when the tip credit is used, and in a pool where everyone gets the full minimum, [supervisors and managers may not take a share](https://legislature.maine.gov/legis/statutes/26/title26sec664.html).

Overtime is one more place where tipped pay can go wrong. The state's guidance is that for a service employee on the tip credit, overtime is calculated on the [full minimum wage, not the lower cash wage](https://www.maine.gov/labor/labor_laws/minimum_wage_faq.html), and the employer may not take a larger credit for an overtime hour than for a regular hour.

## Who Counts as Salaried and Exempt From Overtime Now?

Being paid a salary does not, on its own, end your right to overtime. To be exempt, a worker's salary must exceed [3,000 times the state minimum wage or the federal annualized rate](https://www.maine.gov/labor/news_events/article.shtml?id=13362373), whichever is higher, and from January the line sits at [$905.79 a week](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf).

The salary test is only half of it. The duties of each worker must also be considered, and an individual can earn above the threshold and [still be eligible for overtime](https://www.maine.gov/labor/news_events/article.shtml?id=13362373). The poster warns that failing either the duties test or the weekly salary threshold is a [violation of state law](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf) and possibly federal law too. An assistant store manager who spends most of the week stocking shelves and ringing up customers is the classic case to question.

For everyone who is not exempt, the rule is fixed in the statute. Hours beyond [40 in any one week must be paid at 1 1/2 times the regular hourly rate](https://legislature.maine.gov/legis/statutes/26/title26sec664.html), and that regular rate includes bonuses and commissions earned for the work. Private employers cannot swap that pay for time off later, because compensatory time [cannot be used by private-sector employers](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf), though they may let staff flex hours inside a single workweek. Our guide to [when overtime is legally owed](https://www.metaintro.com/blog/how-many-hours-is-overtime) walks through the federal side of the same rules.

A short list of jobs sits outside Maine's overtime rule, including [mariners and automobile salespersons](https://legislature.maine.gov/legis/statutes/26/title26sec664.html), so check the statute if your role is unusual.

> A salary above [$905.79 a week](https://www.maine.gov/labor/news_events/article.shtml?id=13362373) does not end your right to overtime. What you actually do all day decides it.

## Does Portland Pay More Than the State Minimum?

Yes, and by a clear margin. Portland's own ordinance sets the city minimum at [$17.75 an hour beginning on January 1, 2027](https://content.civicplus.com/api/assets/3899b6d8-7441-4566-853b-0491ef6bc426?cache=1800) for all employees including service employees, then [$19.00 an hour in 2028](https://content.civicplus.com/api/assets/3899b6d8-7441-4566-853b-0491ef6bc426?cache=1800). From 2029 the city rate indexes to [a different measure than the state](https://content.civicplus.com/api/assets/3899b6d8-7441-4566-853b-0491ef6bc426?cache=1800), the CPI-U for the Northeast.

That schedule came from a ballot question that passed with [63% of the vote](https://mainemorningstar.com/2025/11/04/portland-approves-19-minimum-wage-proposal/) in the November 2025 city election. The current city rate is [$16.75 an hour, or $8.38 for service employees](https://www.portlandmaine.gov/minimum-wage), and the city runs its own online complaint form for violations of the local ordinance.

Tipped workers in the city keep a tip credit under the ordinance, but it may be [no greater than half the Portland minimum](https://content.civicplus.com/api/assets/3899b6d8-7441-4566-853b-0491ef6bc426?cache=1800). Ask your employer to show you the city notice for the new year rather than assuming the state poster covers you.

Location of the work decides which rate applies. Under most municipal ordinances, employers must pay the higher wage based on [where the work was performed](https://www.maine.gov/labor/labor_laws/minimum_wage_faq.html), so a worker who spends one day inside a city with a higher minimum may be owed that rate for that day. The state's FAQ lists [Portland and Rockland](https://www.maine.gov/labor/labor_laws/minimum_wage_faq.html) as municipalities with local ordinances, and the 2027 poster tells employers with staff in [Bangor and/or Portland](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf) to check local rules. A worker who brings a local wage complaint to the state will be [referred to the local enforcement agency](https://www.maine.gov/labor/labor_laws/minimum_wage_faq.html).

## What Must Your Employer Post and Put on Your Pay Stub?

The poster is a legal requirement, not decoration. Maine law requires every employer to place the minimum wage poster where [workers can easily see it](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf), and the state has already published the new version. The 2027 poster comes in Arabic, Chinese, English, French, Lingala, Portuguese, Somali and Spanish on the [state's free labor poster page](https://www.maine.gov/labor/posters/index.shtml), and employers can request free printed copies.

Your pay statement has a required minimum. Every employer must give each worker, with each payment of wages, a statement showing the [pay period date, hours worked, total earnings and itemized deductions](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf). Employers must also keep accurate records of hours and wages for [three years](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf). If your January stub still shows the old rate, the stub itself is your evidence, and knowing [how to read each line of a pay stub](https://www.metaintro.com/blog/how-to-read-a-pay-stub) makes the check take a minute.

These are not paperwork technicalities to the state's inspectors. In cases that reached final action from 2023 to 2025, the state found violations of the pay statement rule in [24 cases, and of a separate workplace-rights notice-posting rule in 16 cases](https://legisweb0.legislature.maine.gov/doc/12335). Record keeping failures produced the largest count of violations of any category.

The same enforcement arm covers much more than the minimum wage. The Wage and Hour Division's publications page carries the rules on [rest breaks, earned paid leave, final payment of wages and minimum pay for reporting to work](https://www.maine.gov/labor/labor_laws/wagehour.shtml), all of which apply whether you earn the floor or well above it.

## How Do You File a Complaint if You Are Paid Less?

Online, through the state's wage and hour portal. The portal covers [not being paid at least minimum wage](https://www.maine.gov/labor/complaint/), tip issues, unpaid hours, missing pay statements, rest breaks, vacation pay, earned paid leave, unpaid overtime, bounced paychecks, illegal deductions and being misclassified as salary exempt. Questions go to a labor and safety inspector at [(207) 623-7900](https://www.maine.gov/labor/complaint/).

The state's own numbers show what happens next. In 2025 the division judged [853 requests to be possibly actionable complaints and assigned 493 for investigation](https://legisweb0.legislature.maine.gov/doc/12335). It found at least one violation in [202 of those 493 complaints](https://legisweb0.legislature.maine.gov/doc/12335), and wage violations affecting [1,441 workers who were owed $420,269](https://legisweb0.legislature.maine.gov/doc/12335).

Many cases never need a full investigation. In 2025 the division referred [393 cases for conciliation and resolved 333 of them](https://legisweb0.legislature.maine.gov/doc/12335) by talking to both sides directly. Since a law that took effect on [August 9, 2024](https://legisweb0.legislature.maine.gov/doc/12335), workers who were victims of wage theft can also be awarded liquidated damages on top of the wages owed.

Hospitality is where complaints cluster. Across 2023 to 2025, accommodation and food services had the largest number of complaint cases, with [324 workers owed $545,873](https://legisweb0.legislature.maine.gov/doc/12335) in wages. Minimum wage violations under section 664 showed up in [19 cases with 439 violations](https://legisweb0.legislature.maine.gov/doc/12335) over the same period. Do not sit on a problem, and know that the division will not act on complaints outside [its jurisdiction](https://www.maine.gov/labor/complaint/).

> Your January pay stub is the proof. If it still shows the old rate, the state's [complaint portal](https://www.maine.gov/labor/complaint/) is built for exactly that case.

## Who Earns Near the Minimum in Maine?

Fewer people than the debate suggests, but they are concentrated in the jobs that keep towns running. In 2025 there were [28,000 hourly workers in Maine paid less than $15.00 an hour](https://www.maine.gov/labor/news_events/article.shtml?id=13362373), about four percent of all wage and salary workers and about eight percent of those paid by the hour.

The raise also pushes on wages just above the floor. An employer who lifts new starters to the floor has to think about longer serving staff who were paid just above the old rate, and Portland's higher city rate sets a local benchmark that nearby employers competing for the same staff cannot ignore. Maine is not alone in moving its floor, and our look at [what Florida's tipped workers now earn](https://www.metaintro.com/blog/florida-minimum-wage-15-dollars-september-2026) shows how differently another state treats tipped pay.

## What This Means for Job Seekers, and What Should You Do Next?

This raise is modest in cents and important in principle. It arrives automatically, it applies to farm workers under the [2025 law that brought them under the state minimum](https://www.maine.gov/labor/news_events/article.shtml?id=13362373), and it moves the tipped and salaried thresholds that employers most often get wrong. The risk is not that the raise fails to happen. The risk is that it happens on the poster and not on your paycheck.

Our view is that the workers with the most to gain from paying attention are tipped staff and low salaried supervisors, not full rate hourly workers, whose raise is a single number that is easy to check. A server's weekly top up and a supervisor's overtime eligibility depend on an employer doing math correctly, and the state's own records show that [overtime violations turned up in 31 cases](https://legisweb0.legislature.maine.gov/doc/12335) between 2023 and 2025.

Here is how we would act on it:

- **Hourly workers.** Check your first January pay stub against the [$15.70 rate](https://www.maine.gov/labor/docs/2027/posters/English_minimum_wage.pdf), and if you work in Portland check it against the city rate instead.
- **Tipped workers.** Keep your own weekly log of cash wage and tips, and ask how the employer shows that the combined total meets the minimum.
- **Salaried staff.** If your pay sits near [$905.79 a week](https://www.maine.gov/labor/news_events/article.shtml?id=13362373) and most of your time goes to front line tasks, ask HR in writing how your role meets the duties test.
- **Job seekers.** Use the new floor as your walk away number and treat any posting below it as a warning sign about the employer.

If you are comparing offers, remember that a higher hourly rate in Portland and a lower one elsewhere can look closer once commuting is counted, so weigh the whole job rather than the headline rate.
