Reserve service in Israel is part of life — but what happens to work during that time? Can you be fired? What about pay? Promotion? And does your family have rights too?

Following the “Swords of Iron” war (October 2023) and the prolonged reserve-service crisis that began then, awareness of reservists’ rights rose significantly. New laws were enacted, protections were strengthened, and the Israeli public understood that **reservists and their families need special protection**.

This guide explains **exactly what your rights are** as a reservist, **how the law protects you**, **what rights your family has**, **how to claim your rights if they were violated**, and **what changed in 2024–2026** — in clear language and with practical examples.

## The main law: the Reserve Service Law and employee protections

### **The basic law: “Discharged Soldiers (Reinstatement in Employment) Law, 1949”**

This is the primary law protecting reservists. It was written immediately after the establishment of the state to protect discharged soldiers, and since then it has been expanded to include **reservists**.

**The core principle:**

Reserve service = **service to the state**

It is forbidden to harm an employee because of reserve service

**Core rights:**

Absolute protection from dismissal

The right to return to the same role

Preservation of seniority and rights

### **Additional relevant laws:**

**Reserve Service Law (Temporary Provision), 2018**

Specific rights for prolonged reserve service

**Equal Rights for Persons with Disabilities Law, 1998**

Relevant for those injured during reserve service

**Extension orders in various industries**

Collective agreements with additional protections

> 🔢 Did you know?
>
> Following the “Swords of Iron” war, about 360,000 Israelis were called up for prolonged reserve service — which led to new legislative amendments in 2024 that strengthened workplace protections for reservists and their families.

## Protection from dismissal — the central right

### **The principle: you cannot be fired because of reserve service**

It is forbidden to fire an employee:

- During reserve service
- Because of reserve service (even after release)

**The dismissal is void from the outset:**

- If an employer fires you anyway, the dismissal is **not valid**
- The employee may return to work

### **Protection period:**

**During service + 30 days after:**

Absolute protection — it’s almost impossible to fire

**Up to 90 days after release:**

Still strong protection — the burden of proof is on the employer

**After 90 days:**

It is still forbidden to fire **because of** reserve service, but it’s easier for the employer to prove the dismissal was for another reason

### **What if I was fired anyway?**

**Step 1: Check if it’s legal**

- Were you fired within 30 days of release? **Void from the outset**
- Were you fired because of the reserves? **Forbidden**

**Step 2: Send a demand letter**

- Demand return to work + compensation

**Step 3: Contact a labor lawyer**

- Sue the employer in the labor court

### **Remedies for unlawful dismissal:**

**Reinstatement:**

The court can order the employer to reinstate you

**Double compensation:**

If you are not reinstated — compensation of **up to 2× the usual severance compensation**

**Example:**

- Regular severance: ₪80,000 (5 years × ₪16,000 salary)
- Double compensation: **up to ₪160,000**

**Additional compensation:**

Damages (e.g., lost income while job searching)

Our guide on [Employment in Israel](https://www.metaintro.com/blog/employment-israel-jobs-salaries-smart-tips) explains general rights.

## The right to return to the same role — without harm

### **The principle: return “as if you never left”**

After reserve service, you are entitled to return to:

- **The same role** (or an equivalent one)
- **The same salary** (or higher if there were general raises)
- **The same rights**

### **What does “equivalent” mean?**

If the exact role no longer exists (for example, the department was shut down):

- The employer must provide a role **similar in level, responsibility, and salary**
- They cannot “downgrade” you

### **Seniority is preserved:**

**Reserve service = work:**

Reserve time **counts as regular work** for seniority.

Example: You worked 2 years, served 6 months in reserves, returned → **seniority: 2.5 years**

### **Rights that continue to accrue:**

- **Vacation days:** accrue normally
- **Sick days:** accrue normally
- **Pension seniority:** continues to accrue

### **Can they harm your promotion?**

**No.**

If you were supposed to be promoted (e.g., based on performance the previous year), you **cannot be denied** because of reserve service. If there were general promotions, the reservist is also entitled.

**Example:**

Before reserves you were a [Junior Developer ↗](https://www.metaintro.com?q=help%20me%20find%20a%20junior%20developer%20job)

During your service, all Juniors were promoted to Mid-level

**They must promote you too**, even though you weren’t present

## Pay during reserve service — who pays and how?

### **Who pays?**

**Generally:**

**The army pays** — not the employer

**But:** The employer can **choose** to top up the gap between reserve pay and your regular salary (and some do)

### **How much does the army pay?**

**Reserve pay (2026):**

Depends on rank, role, and length of service

**Average:** ₪250–500 per service day

**Example:**

Regular salary: ₪15,000/month = ₪500/day (30 days)

Reserve pay: ₪350/day

**Loss: ₪150/day = ₪4,500/month**

### **Is the employer required to top up?**

**By law — no.**

**But:** Many companies **choose** to top up the gap (especially in tech)

**Why?**

- Morale
- Appreciation
- Company reputation

### **Companies that top up:**

Most large tech companies (Google, Meta, Microsoft, Intel)

Large banks

Companies with strong social culture

### **Can you demand a top-up?**

**Not by law** (unless there’s a collective agreement or personal contract)

**But:** There is strong public pressure on companies to do so

Our guide on [Income tax](https://www.metaintro.com/blog/income-tax-calculation-israel-2025) explains taxation of reserve pay.

## Rights for reservists’ families — recognizing the burden

After the “Swords of Iron” war, lawmakers understood that **reservists’ families carry a heavy burden** — and therefore enacted new rights.

### **1. Paid absence days for the spouse**

**New law (2024):**

A reservist’s spouse is entitled to **up to 5 paid absence days** per year

**Conditions:**

- The reservist serves **at least 30 consecutive days**
- There are children under 18 (or under 21 if in military/national service)

**Use:**

For childcare, household arrangements, or simply rest

**Payment:**

The employer pays **full salary** for these days

### **2. Workplace flexibility**

**The law requires employers to:**

- Allow flexible working hours
- Allow working from home (if feasible)
- Respond to requests for vacation days

### **3. Protection from harm to promotion**

A spouse cannot be harmed because of:

- Absences due to childcare during the reserve period
- Requests for flexibility
- Fatigue or stress

### **4. Sick leave approval**

If the spouse is affected by the pressure (emotionally or physically), they are entitled to sick pay **as usual**

### **5. Legal aid and support**

Various government offices and organizations offer **free legal advice** for reservist families whose rights were harmed

## Additional rights — benefits and assistance

### **1. Income tax credit point for prolonged reserve service**

**If you served more than 30 days in a year:**

You are entitled to **an additional tax credit point** (0.5–1 point)

**Value:** savings of ₪100–300 per month in tax

### **2. Government financial support**

**For self-employed and business owners:**

Grants and financial support (depends on circumstances)

**For families in distress:**

Additional financial assistance

### **3. Job placement assistance**

**If you lost your job because of reserve service** (even though it’s forbidden):

The Employment Service provides placement support

### **4. National Insurance — disability benefits if you were injured**

**If you were injured during reserves:**

You may be entitled to disability benefits from National Insurance, full medical treatment, and vocational rehabilitation

Our guide on [Bituach Leumi](https://www.metaintro.com/blog/why-pay-bituach-leumi-israel-2026) explains benefits.

## What’s new? Legislative amendments 2024–2026

After the “Swords of Iron” war, important amendments were enacted:

### **Amendment 1: Increased protection for employees in small companies**

**Previously:** Small companies (under 20 employees) could claim financial hardship

**Now:** It’s harder — they must prove **real and extreme** hardship

### **Amendment 2: Absence days for families**

**New:** 5 paid absence days for the spouse (didn’t exist before)

### **Amendment 3: Stronger enforcement**

- **Higher fines** for violating employers
- **Easier lawsuits** — lighter burden of proof on the employee

### **Amendment 4: Support for the self-employed**

Self-employed people with prolonged reserve service may be entitled to:

- Deferral of payments (tax, National Insurance)
- Special grants

## How to claim your rights: the practical guide

### **Step 1: Document everything**

Keep:

- Call-up order
- Service confirmations
- Correspondence with the employer

### **Step 2: Talk to the employer**

Sometimes it’s a mistake or misunderstanding:

- Send a reasoned email with the relevant law
- Ask to correct the harm

### **Step 3: Contact HR**

If the manager doesn’t help, HR should handle it

### **Step 4: Seek legal advice**

**Organizations that help:**

- “Working Soldiers” organization (free advice)
- Israel Bar Association — initial consultation

### **Step 5: File a claim in labor court**

If the employer doesn’t fix it — **sue**

Labor courts handle these cases with priority

### **Step 6: Use the media (if needed)**

**In extreme cases:** Media exposure can pressure the employer

## FAQ

**Can you fire a reservist for a reason unrelated to reserve service?**

Yes, but it’s difficult. The employer must prove the reason is **not related at all** to reserve service.

**What if the company shut down while I was in reserves?**

If it’s a **real closure** (not an excuse), it can be legal — but the employer must prove it.

**Is an employee in a probation period protected?**

**Yes.** Protection applies even during probation.

**What if I’m a temporary employee or contractor?**

Protection can apply **also** to temporary workers and subcontractors (under certain conditions).

**Can I ask for financial compensation instead of returning to work?**

Yes. If you don’t want to return, you can claim double compensation instead.

**What about bonuses tied to presence?**

You cannot be harmed in your bonus because of reserve service — reserve time is considered as presence.

## Reservists get full legal protection

Reservists and their families benefit from **strong legal protection** in Israel — and following the “Swords of Iron” war, that protection only became stronger.

**Key points:**

- **Absolute protection from dismissal** — void from the outset; double compensation if violated
- **Right to return to the same role** — salary, seniority, and promotion are preserved
- **Families are protected** — 5 absence days, flexibility, protection from harm
- **New legislative amendments** — stronger enforcement, broader protection
- **If your rights were harmed — claim them** — labor courts support reservists

**Remember: reserve service is service to the state — and the state and the law protect you and your family. Know your rights and don’t hesitate to demand them.**

Thank you for your service, and good luck!
