WARN notices, severance, and unemployment basics

What should I do in the first week after a layoff?

Get the details in writing: your last day, final paycheck date, severance terms, and when health coverage ends. File for unemployment with your state as soon as your job ends. Do not sign a severance agreement on the spot; read the release first. Losing employer coverage opens a 60-day window to elect COBRA or enroll in a marketplace plan. Then update your resume and start applying while your network still remembers your last role.

What is a WARN notice?

The federal WARN Act generally requires employers with 100 or more full-time workers to give 60 days of written notice before a plant closing or mass layoff. Several states add their own rules: New York and New Jersey require 90 days, and California covers employers with 75 or more workers. WARN filings are public records, and this tracker links the notice whenever one has been filed.

Am I entitled to severance pay?

In the US, no federal law requires severance. It comes from company policy, your employment contract, or a union agreement. New Jersey is a notable exception for mass layoffs covered by its state WARN law. Severance is usually paid in exchange for releasing legal claims. If you are 40 or older, federal law gives you 21 days to review the agreement (45 days in a group layoff) and 7 days to revoke it after signing.

Can I collect unemployment after a layoff?

Usually, yes. A layoff is a qualifying separation in every state. Apply through your state's unemployment agency right after your last day, because benefits generally start from the week you file. Most states pay up to 26 weeks. Depending on the state, severance pay can delay or reduce your benefits.
